Plain talk about what our deliverables are, what they are not, and where your responsibility begins.

1. Name Ideas Are Creative Suggestions Only

We do not search trademarks. We do not check name availability.

The ten name ideas we deliver are starting points — creative candidates shaped for your trade. That is all they are.

We do not search the U.S. Patent and Trademark Office (USPTO) database, any state trademark database, any state or county assumed-name (DBA) registry, any domain name registry, or any social media availability checker before we deliver your names.

Your responsibility: Before you register, file, or publicly use any name we suggest, you should (a) check domain registration availability, (b) search the USPTO database at uspto.gov, (c) search your state's business name registry, and (d) consult a trademark attorney if you plan to build significant commercial value around that name. A name suggestion from us is not clearance to use it.

We are not liable for any cost, loss, or legal claim arising from your use of a suggested name that turns out to be unavailable, registered, or infringing.

2. Images Are Not Exclusive

Your images are licensed to you — not guaranteed unique to you.

The images included in your package are AI-generated from pools shaped for your trade category. They are licensed to you for your own business marketing use. You did not purchase exclusive rights.

Because AI image generation is probabilistic, other customers in a similar trade may receive images that look similar to yours. We cannot guarantee that any image in your package is visually unique.

Your responsibility: If you need exclusive rights to an image — for example, to register it as a trademark or to use it as the sole identifier of your brand — you should commission original artwork from a human designer and obtain an assignment of copyright in writing.

We are not liable for any claim of confusion, infringement, or loss arising from similarities between your delivered images and images delivered to others.

3. We Do Not Give Professional, Legal, or Regulatory Advice

We hand you a starting place. Your industry's rules are yours to follow.

Nothing we deliver — name ideas, story copy, images, or landing page files — constitutes legal advice, professional advice, regulatory compliance advice, or guidance of any kind on how to operate your business or market your services under applicable law.

No attorney-client relationship, professional advisory relationship, or fiduciary relationship is created by purchasing from Texas Footprint.

Regulated trades and professions: If you work in a regulated field, you are solely responsible for making sure your presence, marketing, and operations comply with your industry's rules. Examples include but are not limited to:
  • Electrical and HVAC contractors — state licensing and advertising rules vary. Texas, California, and other states require license number disclosure in contractor advertising.
  • Plumbers — state licensing and bonding disclosure requirements apply in many states.
  • Oilfield services — state and federal occupational safety, environmental, and licensing rules govern operations and any public-facing marketing claims.
  • Roofers — some states restrict storm-chasing solicitation and require license disclosure.
  • Real estate professionals — state licensing, fair housing advertising rules, and MLS rules apply.
  • Medical and health services — HIPAA, state licensing, and FDA rules may apply to marketing claims.
  • Financial and investment services — SEC, FINRA, and state rules on advertising and testimonials apply.
  • Legal services — unauthorized practice of law and state bar advertising rules apply.
  • Immigration services — DOJ/EOIR accreditation rules apply; unauthorized practice is a federal matter.

We did not design your deliverables to comply with any specific state or federal licensing advertising standard. Review your deliverables against your industry's rules before you publish them.

4. Results Are Not Guaranteed

We give you the pieces. What you do with them is up to you.

We make no promise that your name ideas will lead to a registered business, that your images will attract customers, that your landing page will rank in search results, or that your presence will generate any particular business outcome.

Commercial results depend on many things outside our control: your market, your pricing, your service quality, your follow-through, local competition, and economic conditions. We deliver creative starting pieces. Business results are yours to build.

5. No Warranty on Deliverables

The deliverables are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our total liability to you is limited to the total amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages. See our Terms of Service for the full limitation of liability language.
